This license agreement is an agreement between you (either an individual or an entity) and JJMdesigns. This Software is licensed, not sold. By installing, or otherwise using the Software, you agree to be bound by the terms of this license agreement. The installation and/or use of the Software and any updates or other components of the Software indicate your understanding and acceptance of the following terms and conditions. This license shall supersede any verbal or written, or prior verbal or written, statement or agreement pertaining to the Software.
This license agreement permits you to use one copy of the Software & Worksheets on up to 5 computer/workstations. The Software is "in use" on a computer when it is loaded into the temporary memory (i.e., RAM or Cache) or installed into the permanent memory (e.g., hard disk, CD-ROM drive, or other storage device) of that computer. All intellectual property including all animations, images, etc. incorporated into the software are the property of JJMdesigns. You must treat the Software like any other copyrighted material, except that you may make one copy of the Software solely for backup purposes.
You may not use the Software on or over a network or any other transfer devise (including the internet). Single program license purchase allows installation on maximum of 5 computers and use of practice worksheets in a single classroom setting.
*Site license permits installation and use of program and worksheets within a school building. Software programs/worksheets may not be distributed in any form outside the school district.
Use of the Software & or worksheets on more than 5 computers in a single classroom with single program license purchase constitutes copyright infringement and may be punishable by civil fines, criminal penalties or both.
You may not rent or lease the Software or worksheets.
You may not modify, reverse engineer, decompile or disassemble the Software or Worksheets, except to the extent that this restriction is expressly prohibited by law.
You may not remove any proprietary notices or labels from the Software or Worksheets.
You may not distribute, create, or use any means that render this program registered and/or unrestricted in its features.
This Software & Worksheets and/or documentation included with them and/or documentation online at http://www.jjmdesigns.com are provided on an "as is" basis, without any representation or warranty of any kind, including accuracy, reliability, or correctness. The entire risk of this program is assumed by the user and/or licensee. JJMdesigns does not assume liability for the use, installation, and distribution of this Software. In no event will JJMdesigns be liable for any direct or indirect damages including any lost profits, lost savings, loss of information, any other loss or other incidental or consequential damages arising from any defects out of the use of or inability to use this program, even if JJMdesigns has been advised of the possibility of such damages.
You agree to hold JJMdesigns harmless from and against any and all claims, losses, liability costs and expenses arising from your violation of this agreement. This obligation will survive any termination of this agreement.
Without advertising, JJMdesigns has all rights to terminate the services included in the Software including, but not limited to, technical support, upgrades, sales, prices, and other activities related to the program.
If you do not understand or accept these terms, or your local regulations prohibit license agreements or limited disclaimers, you must cease and desist using any and all programs from JJMdesigns immediately. When you accept and approve this license, it is considered that you have read it and you will respect it.
